 IMPLANT RETURN POLICY 

1. No possibility of returning the following sterilised products:

●   implants: TGR, transpedicular screws, calcaneal prostheses, TTA and TTAR+ wedges
●   holders and torque wrenches
●   SpinoFIX containers

Other products also cannot be returned if their packaging has come into contact with bodily fluids.

2. Non-sterilised implants may be returned up to 14 days from the date of receipt of the shipment, in the original and undamaged packaging (free of charge).

3. Sterilised implants not listed in point 1, may be returned up to 14 days from the date of receipt of the shipment in the original, sealed packaging, with an additional cost of 20% of the implant value.

 


1. GENERAL PROVISIONS

1.1 The Online Store available at https://iwet.store or https://iwetvet.abstore.pl is operated by IWET Marta Lubak, with its registered office at ul. Szałwiowa 18, 15-523 Grabówka, Poland; NIP: 5451754732, REGON: 361757210, e-mail address: iwet@iwet.vet, phone number: +48 606490165, hereinafter referred to as the "Seller".

1.2 These Terms and Conditions and the Online Store are addressed exclusively to business entities using the Online Store (these Terms and the Store are not addressed to consumers).

1.3 The Seller is the controller of personal data processed in connection with the implementation of these Terms and Conditions via the Online Store. Personal data are processed for the purposes, to the extent, and based on the grounds and principles set out in the privacy policy published at https://iwet.store/polityka-prywatnosci-firmy-iwet or https://iwetvet.abstore.pl/polityka-prywatnosci-firmy-iwet. The use of the Online Store, including placing orders, is voluntary. Similarly, providing personal data by the Service Recipient or Customer using the Online Store is voluntary, except in cases indicated in the privacy policy (contract conclusion and the Seller’s legal obligations).

Definitions:

  • BUSINESS DAY – any day from Monday to Friday excluding public holidays.

  • REGISTRATION FORM – a form available in the Online Store that allows the creation of an Account.

  • ORDER FORM – an Electronic Service, an interactive form available in the Online Store that allows placing an Order, particularly by adding Products to the electronic cart and specifying the terms of the Sales Agreement, including payment method.

  • CUSTOMER – (1) a natural person with full legal capacity whose use of the Website, including entering into Sales Agreements, is directly related to their business or professional activity (not acting as a consumer); (2) a legal person; or (3) an organizational unit without legal personality granted legal capacity by law – who has concluded or intends to conclude a Sales Agreement with the Seller.

  • CIVIL CODE – the Civil Code Act of April 23, 1964.

  • PRODUCT – a movable item available in the Online Store that is the subject of a Sales Agreement between the Customer and the Seller.

  • TERMS AND CONDITIONS – these terms and conditions of the Online Store.

  • ONLINE STORE – the Seller’s online store available at https://iwet.store or https://iwetvet.abstore.pl.

  • SALES AGREEMENT – a sales agreement or agreement for the manufacture of a Product concluded between the Customer and the Seller via the Online Store.

  • ELECTRONIC SERVICE – a service provided electronically by the Service Provider to the Service Recipient via the Online Store.

  • SERVICE RECIPIENT – (1) a natural person with full legal capacity whose use of the Website is directly related to their business or professional activity (not a consumer); (2) a legal person; or (3) an organizational unit without legal personality granted legal capacity by law – using or intending to use an Electronic Service.

  • ORDER – the Customer's declaration of intent made via the Order Form and aimed directly at concluding a Sales Agreement with the Seller.


2. ELECTRONIC SERVICES IN THE ONLINE STORE

The following Electronic Services are available in the Online Store: Account, Registration Form, and Orders.

Account – Creating an Account requires three steps:

  1. Completing the Registration Form,

  2. Clicking the “Register” button,

  3. Receiving confirmation from the Seller of account creation.

The following Customer data must be provided in the Registration Form: full name/business name, address (street, building/apartment number, postal code, city, province, country), e-mail address, contact phone number, password, NIP number, and type of business activity.

The Electronic Service "Account" is provided free of charge for an indefinite period. The Service Recipient may delete the Account at any time without stating a reason by sending an appropriate request to the Service Provider, in particular via email at iwet@iwet.vet or in writing to ul. Szałwiowa 18, 15-523 Grabówka.

Order Form – Using the Order Form begins when the Customer adds the first Product to the online shopping cart. Placing an Order requires:

  1. Completing the Order Form,

  2. Clicking the “Confirm order” button on the Online Store page.

Until the “Confirm order” button is clicked, the Customer can modify the entered data. The following Customer data is required in the Order Form: full name/business name, NIP number, address, e-mail address, phone number, and sales details: Products, quantity, delivery method and address, payment method.

The Electronic Service "Order Form" is provided free of charge and on a one-time basis. It ends either upon placing the Order or upon the Customer’s earlier cessation of the order process.

Technical requirements necessary to use the Online Store:

  • Computer, laptop, or other multimedia device with Internet access;

  • Access to e-mail;

  • Internet browser: Mozilla Firefox 17.0+, Internet Explorer 10.0+, Opera 12.0+, Google Chrome 23.0+, Safari 5.0+, Microsoft Edge 25.10586.0.0+;

  • Enabled cookies and JavaScript in the browser.

The Service Recipient is obliged to use the Online Store in accordance with the law, good practices, and with respect for personal rights, copyrights, and intellectual property of the Service Provider and third parties. The Service Recipient must provide truthful data and refrain from providing unlawful content.

Complaint Procedure:
Complaints related to the provision of Electronic Services or to the functioning of the Online Store (excluding Product complaints under section 6) can be submitted:

  • In writing to: ul. Szałwiowa 18, 15-523 Grabówka

  • By e-mail to: iwet@iwet.vet

It is recommended that the complaint includes: (1) information about the subject of the complaint and circumstances (e.g., type and date of the issue); (2) the Customer’s request; (3) contact details. This is a recommendation and not a condition for effective complaint submission.

The Service Provider shall respond to complaints promptly, no later than within 14 calendar days of submission.


3. TERMS OF CONCLUDING A SALES AGREEMENT

A Sales Agreement between the Customer and the Seller is concluded after the Customer submits an Order via the Order Form in accordance with section 2.1.2 of the Terms.

Product prices are shown in Polish zloty (PLN). The total price, including taxes and delivery costs (e.g., shipping fees), is provided in the Order confirmation email sent to the e-mail address provided by the Customer.

Procedure for concluding a Sales Agreement via the Order Form:

  1. The Customer submits an Order as described in section 2.1.2.

  2. The Seller immediately confirms receipt of the Order and accepts it for processing by sending an email to the Customer. The message includes the Seller's statements on receipt and acceptance of the Order and confirmation of the Sales Agreement.

  3. The Sales Agreement is concluded when the Customer receives this confirmation email.

The content of the Sales Agreement is recorded, secured, and made available to the Customer by:

  • Providing these Terms and Conditions on the Store’s website, and

  • Sending the confirmation email as described above.

The content is also stored in the Seller's IT system.

4. METHODS AND TERMS OF PAYMENT FOR THE PRODUCT

The Seller offers the following payment methods for the Sales Agreement:

  • Cash on delivery (COD).

  • Cash payment upon personal collection.

  • Bank transfer after receiving a VAT invoice included with the shipment.

Payment deadline:

  • If the Customer chooses payment via bank transfer after receiving the VAT invoice, payment must be made within the deadline specified on the invoice.

  • If the Customer chooses cash on delivery or cash upon personal collection, payment must be made upon receipt of the shipment.


5. COST, METHODS AND TIME OF DELIVERY AND COLLECTION OF THE PRODUCT

Product delivery is also available outside the territory of the Republic of Poland.

Product delivery to the Customer is subject to a fee unless otherwise stated in the Sales Agreement. Delivery costs (including transport, shipping, and postal charges) are indicated to the Customer on the Online Store’s pages during Order placement, including at the moment of expressing the intention to conclude the Sales Agreement.

Personal collection of the Product by the Customer is free of charge.

The Seller provides the following methods of delivery or collection:

  • Courier shipment, including cash-on-delivery (COD) courier.

  • Personal collection available at: ul. Szałwiowa 18, 15-523 Grabówka – from Monday to Friday, between 10:00 AM and 3:00 PM, excluding public holidays and non-working days.

The delivery date of the Product is individually confirmed for each Order after the Seller checks the availability of the ordered Product in stock.


6. PRODUCT COMPLAINT

Pursuant to Article 558 § 1 of the Civil Code, the Seller's liability under the warranty for defects in the Product towards the Customer is excluded.


7. ADDITIONAL PROVISIONS

The Seller reserves the right to limit the available payment methods, including requiring full or partial prepayment, regardless of the Customer's chosen payment method or the fact that a Sales Agreement has been concluded.

The Service Provider may terminate the agreement for the provision of Electronic Services with immediate effect and without providing reasons, by sending the Service Recipient an appropriate declaration.

Upon the Seller handing over the Product to the carrier, the benefits and burdens related to the Product, as well as the risk of accidental loss or damage, transfer to the Customer. In such cases, the Seller is not liable for the loss, shortage, or damage of the Product occurring from the moment it is accepted for transport until its delivery to the Customer, nor for delays in shipment delivery.

The Service Provider may terminate the Electronic Services Agreement with immediate effect and without stating the reasons by sending a relevant declaration to the Service Recipient.

The liability of the Service Provider/Seller to the Service Recipient/Customer, regardless of the legal basis, is limited—both for a single claim and for all claims in total—to the amount of the price paid and delivery costs under the Sales Agreement, but no more than PLN 500. The Service Provider/Seller shall be liable to the Service Recipient/Customer only for typical foreseeable damages at the time of the contract’s conclusion and is not liable for lost profits.

All disputes arising between the Seller/Service Provider and the Customer/Service Recipient shall be submitted to the court having jurisdiction over the registered office of the Seller/Service Provider.


8. FINAL PROVISIONS

Contracts concluded through the Online Store are concluded in the Polish language.

Amendments to the Terms and Conditions:

The Service Provider reserves the right to amend the Terms and Conditions.

In the case of contracts other than continuous contracts (e.g., Sales Agreements) concluded based on these Terms and Conditions, any amendments will not in any way affect the rights acquired by Service Recipients/Customers prior to the effective date of the amendments. In particular, amendments will not affect Orders already placed or submitted, or Sales Agreements already concluded, being performed, or executed.

For matters not regulated in these Terms and Conditions, the provisions of Polish law shall apply, in particular:

  • the Civil Code,

  • the Act on the Provision of Electronic Services of 18 July 2002,

  • and other applicable legal regulations.
